1. General

These Terms of Service (“Terms”) govern your use of the websites pawsnsurf.com and academy.pawsnsurf.com (together, the “Website”), the dog grooming services, and the online educational courses provided by Viktoriia Valietova, sole proprietor operating under the trade name PawsN’Surf (“PawsN’Surf”, “we”, “us”, or “our”), NIF 310768918, with professional premises at Rua General Taborda 7, 1070-138 Lisboa, Portugal.

By accessing the Website, making a booking, creating an account, or purchasing a course, you agree to be bound by these Terms. If you do not agree, please do not use our services.

You must be at least 13 years of age to use the Website or purchase our services. If you are between 13 and 18, you must have the consent of a parent or legal guardian.

Part A - Grooming Salon

2. Grooming Services

PawsN’Surf provides professional dog grooming services, including but not limited to full body grooming, hand stripping, wash & go, and pawdicure. Service descriptions and prices on the Website are for informational purposes. Final pricing may vary depending on the condition of the dog’s coat, size, temperament, and any additional work required, as assessed by the groomer at the time of the appointment.

3. Bookings

3.1 Making a Booking

Bookings can be made through the Website. By completing a booking, you confirm that the information provided (including pet breed, name, and contact details) is accurate and complete.

3.2 Confirmation

A booking is confirmed once you receive a confirmation via the Website, email, or WhatsApp. We reserve the right to refuse or cancel a booking at our discretion, including in cases of incomplete information or scheduling conflicts.

3.3 Cancellation & No-Show Policy

You may cancel or reschedule a booking free of charge up to 24 hours before the scheduled appointment time via the Website or by contacting us directly.

If you fail to show up for a confirmed appointment (“no-show”), the following applies:

  • First no-show: your next booking will require prepayment to confirm the appointment.
  • Second no-show: all future bookings will require prepayment.

No monetary penalty is charged for a no-show, but prepayments made for future bookings are non-refundable if you do not show up again.

3.4 Cancellation by PawsN’Surf

We reserve the right to cancel or reschedule appointments due to unforeseen circumstances (groomer illness, emergency, force majeure). In such cases, we will notify you as soon as possible and offer an alternative date at no additional cost. Any prepayment will be fully refunded or credited toward a future appointment, at your choice.

4. Payment for Grooming Services

Payment for grooming services is due on-site upon completion of the appointment. We accept cash, debit/credit cards, and MBWay. Prices include VAT at the applicable Portuguese rate.

In certain cases (see Section 3.3), prepayment may be required to confirm a booking. Prepaid amounts are non-refundable in the event of a subsequent no-show.

5. Client Responsibilities

  • Arrive on time for your appointment. A grace period of 15 minutes may apply; after that, the appointment may be treated as a no-show.
  • Ensure your dog is up to date on vaccinations (at minimum, rabies and core vaccines). We may request proof of vaccination.
  • Inform us in advance of any medical conditions, allergies, behavioral issues, or special needs your dog may have.
  • Dogs must be leashed or securely transported when arriving at and leaving the salon.
  • Aggressive dogs that pose a risk to the safety of our staff may be refused service without compensation.

6. Health and Safety

Our groomers are trained professionals who exercise the utmost care. However, grooming involves the use of sharp instruments, dryers, and chemical products (shampoos, conditioners). Minor incidents such as small nicks or skin irritation, while rare, can occur - particularly on dogs with matted coats, skin conditions, or nervous temperaments.

If we discover any pre-existing condition (skin lesions, parasites, lumps) during grooming, we will inform you and may recommend a veterinary consultation. PawsN’Surf is not a veterinary service and does not provide medical diagnoses or treatments.

In the unlikely event of an injury during grooming caused by our negligence, we will provide immediate first aid, notify you, and cover reasonable veterinary costs.

Part B - PawsN'Surf Academy

7. Academy Courses

PawsN’Surf Academy offers online dog grooming courses delivered through the Website. Courses consist of video lessons, written materials, quizzes, and certificates of completion. Course content is available in multiple languages (English, Portuguese, Ukrainian, Spanish, and Russian), depending on the specific course.

We reserve the right to update, modify, or discontinue course content at any time to improve quality or accuracy. Your access to purchased courses will not be affected by such updates.

8. Course Purchases and Refund Policy

Courses are purchased through the Website via Stripe, a third-party payment processor. By completing a purchase, you agree to pay the listed price and authorize Stripe to process the payment.

All course purchases are final and non-refundable. Courses are digital products. In accordance with Article 16(m) of EU Directive 2011/83/EU, by purchasing and accessing a course, you expressly consent to the immediate provision of digital content and acknowledge that you lose your right of withdrawal once access to the course content has been granted.

Free courses may be offered and can be enrolled in without payment. We reserve the right to change free courses to paid courses at any time; however, if you have already enrolled, your access will not be revoked.

9. Course Access and License

Upon purchase, you are granted a personal, non-transferable, non-exclusive license to access and view the course content for your own private educational purposes. You may not:

  • Share, distribute, or resell course content or your account credentials.
  • Record, download, or reproduce course videos or materials except where a downloadable format is explicitly provided.
  • Use course content for commercial purposes or to create competing educational products.

Violation of these restrictions may result in immediate termination of your access without refund.

10. Certificates

Upon successful completion of a course (including all required quizzes), you will receive a digital certificate of completion. Certificates include your name, the course title, a unique certificate number, and the date of issuance. Certificates are publicly verifiable via a unique URL.

PawsN’Surf Academy certificates attest to the completion of the course curriculum. They do not constitute a professional license, government-issued accreditation, or veterinary qualification.

Part C - General Provisions

11. User Accounts

You may create an account on the Website to manage bookings, store pet information, and access purchased courses. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You may register using email/password or through Google sign-in. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or abusive purposes.

12. Communications

By providing your contact information, you agree to receive transactional communications related to the services you use, including:

  • Email: booking confirmations, reminders, updates, academy enrollment confirmations, course completion notifications, and certificate issuance.
  • WhatsApp: booking confirmations, reminders, and updates sent to the phone number you provide during booking.
  • Push notifications: if you opt in via the Website, you may receive browser push notifications about your appointments.

These are transactional messages necessary for service delivery and are not marketing communications. You can opt out of WhatsApp and push notifications at any time by contacting us or adjusting your browser settings.

13. Intellectual Property

All content on the Website - including text, images, logos, graphics, videos, course materials, and software - is the property of PawsN’Surf or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent, except as expressly permitted under Section 9.

14. Limitation of Liability

To the maximum extent permitted by applicable law, PawsN’Surf shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Website, grooming services, or academy courses.

For grooming services, our total aggregate liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

For academy courses, our total aggregate liability shall not exceed the purchase price of the specific course giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

15. Privacy

Your use of the Website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (GDPR).

16. Modifications

We may amend these Terms at any time by posting the revised version on the Website with an updated “Last updated” date. Continued use of the Website or services after changes are posted constitutes acceptance of the modified Terms. For material changes affecting existing course purchases, we will make reasonable efforts to notify affected users by email.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, without prejudice to any mandatory consumer protection provisions that may apply under your country of residence.
